This Privacy Policy outlines the information we collect hereinafter referred to as “The Information” and its intended use. We also encourage you to read our Terms of Service, which detail the terms governing the use of our Services.

The services provided by TRACKITUP, also known as Track It Up, are administered by TRACKITUP, INC a Delaware corporation with offices in Tampa, FL USA.

Information Collected

We may collect information that includes: personal information, sport activity data, location, routes, photographs, texts, videos, tags, or any other content you publish through Track It Up. 

Location Information

For an optimal experience, Track It Up requires permanent access to your location to capture your activities while you are training and not actively using the app on the screen. The information collected will be solely related to your sports activities. We will also collect your location and associated information provided by third party entities such as wearable and sport tech brands.

Information Usage

We require highly accurate information to bring you the most optimal experience in our services. Aiming to generate the highest value to you with meaningful insights and experiences while using Track It Up. 

Information Sharing

By using our services you acknowledge that the information loaded will be available to other users, in some instances to the general public in our communication channels. We may use information for advertisement. By accepting this agreement, you authorize us to use your information and posts for commercial use in advertisements and offers, without generating any compensation for you.

Information Protection

Track it Up applies appropriate measures to protect your information based on sensitivity. We utilize security controls for data storage, transmission, and consumption.  However, it is important to note that while we strive to maintain robust security, we cannot ensure absolute security of your account or information. You can also enhance your account’s security by creating a strong, unique password for our services, not using this password for other services, refraining from sharing it with others, and promptly reporting any suspicious activity or unauthorized access to your account.

Information Retention and Deletion

Information is retained as long as necessary to provide the services to you. Profile information will be retained as necessary or until your account is deleted. In addition you can delete some information from  our services (i.e. profile information). you can request to delete your account by submitting a request to the contact information provided in this policy. In addition, information may be retained to enforce terms of service, troubleshoot problems, comply with laws and prevent fraud.

By accepting this agreement, you understand and agree that you are responsible for the content you post on the platform and send via email, messaging apps, or other means, and not Track It Up.

Track It Up does not routinely curate or moderate the information and content posted on its platform by you or other users; therefore, we cannot guarantee its integrity or quality. However, if Track It Up finds material it deems inappropriate or malicious at its discretion, it may remove it without prior notice. By accepting this agreement, you acknowledge that Track It Up is not the only entity publishing information on the platform, and therefore, you may be exposed to content you find offensive or inappropriate posted by other users. Therefore, Track It Up is not responsible for the outcome of your consumption of such content.

By accepting this agreement, you acknowledge that you are solely responsible for the information and content you publish on the platform, and if it violates this agreement or the laws in your country, you may be held legally responsible. You also agree that the nature of the relationship between Track It Up and the user is not confidential, and all content and information will be considered non-confidential. Therefore, when you post any information or content to the platform, Track It Up will be considered the public recipient of it. The only responsibility Track It Up has regarding your information or content is as stipulated in the privacy policy.

Track It Up informs you that it will only process the information you upload to the application yourself, including personal information (email), progress, routes, photographs, texts, videos, tags, or any other content you publish through Track It Up. This information will be stored on servers contracted by Track It Up for this purpose and will be deleted when you decide to permanently delete your account. Your payment information will not be processed by Track It Up but by certified third parties for handling this information.

International Data Transfers

Your information may be transferred to, and processed in, countries other than the country in which you are resident. These countries may have data protection laws that are different from the laws of your country. We will take all necessary measures to ensure that your data is treated securely and in accordance with this Privacy Policy and applicable data protection laws.

Welcome to Track It Up. In this document, you will find the conditions of our relationship and the rights and duties that we agree upon to ensure you have the best competitive experience while using our services.

Service Terms

Track It Up also known as TRACKITUP, its platform, website, and any services added to these are designed and managed by TRACKITUP, INC a Delaware corporation headquartered in Tampa, Florida and may be used by you subject to the following terms (the agreement).

By accepting this agreement, you acknowledge that you are aware of and will comply with its present terms and conditions or those added in the future with proper notice from Track It Up.

You are considered to have accepted this agreement if you access, use, upload, or download information to or from the platform, by indicating that you accept this agreement, by creating an account, or by clicking on register. If for any reason you do not accept the terms and conditions contained in this agreement, please do not use any of the services offered by Track It Up.

In the event that you access Track It Up services as a representative of a sports club, a company, an association, or another entity other than a natural person, by accepting this agreement, you declare that you have full consent and authorization to represent such entity. In this case, when referring to the user in this agreement, it shall also be understood to refer to the entity you represent. If you are not fully authorized, please use Track It Up services solely as a natural person.

Modification of Terms and Services

Track It Up reserves the right to update the Terms, conditions, and features of this agreement or its platform at any time and for any reasons it deems appropriate at its sole discretion. Any changes made to this agreement will be notified to you by Track It Up when accessing or using the Services after we have notified you of a modification, you agree to be bound by the modified Terms. If the modifications to the terms and conditions are not acceptable to you, your sole recourse is to stop using the Services.

Track It Up and its third-party service providers may make improvements and/or modifications to the Services, products, other services, mobile applications, features, programs, and prices described at any time and for any reason at its sole discretion. The mobile application may download and install updates, enhancements, and additional features to improve, expand, and further develop the Services. Track It Up reserves the right to modify or discontinue, temporarily or permanently, the Services or any part thereof at any time with or without prior notice. You agree that Track It Up shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Services.

Registration and Accounts

Age of use: Track It Up is intended for individuals over the age of 13. For users between the ages of 13 and the legal adult age, by accepting this agreement, you declare that it has been read and approved by your adult guardian.

User Data: By subscribing, you agree to (1.) provide true, accurate, current, and complete information about yourself and (2.) update it in the “Profile” section or wherever required if there is a change in your information. By accepting this agreement, you agree that Track It Up may use your data for the provision of the service. It is grounds for termination of this agreement and the cancellation of the account or future services that Track It Up has a reasonable suspicion of not providing true, accurate, current, and complete information about yourself.

Confidentiality of access: By accepting this agreement, you agree that maintaining the confidentiality of the password to access Track It Up is solely your responsibility and that permissions granted to computers, mobile phones, tablets, smartwatches, or others depend solely on you.

Responsibility for activities: You agree to be solely responsible for the activities performed on any Track It Up platform, including but not limited to your behavior on the route and your safety.

Track It Up constantly strives to block potential unauthorized access to your account. However, we cannot guarantee absolute security that your account or data cannot be viewed through hacking actions that can access your content through fraudulent practices. Therefore, we ask that by accepting this agreement, you commit to informing Track It Up of any unauthorized use of your account, membership, or password.

Registration via Third Parties: To register with Track It Up, you can do so through available networks. If done this way, you authorize Track It Up to use the information provided in that network to complete your profile information and use the credentials to access Track It Up.

Payments and Fees

Payments

Track It Up is an application where you can find paid events. Therefore, to access those events and services, you must purchase a membership for that event. To make the payment for the membership you choose, you must provide information about the payment method such as debit or credit cards or any other payment method available on the Track It Up platform. By providing us with your payment data, you authorize us and the external service provider processing the payment to receive, store, and encrypt said information.

Change of payment method: You can change your payment method whenever you need to, for this, go to your profile payment section. If at any time you detect unauthorized charges or payments that you consider fraudulent directed to Track It Up, contact Support.

Fees

Track It Up is an application where you can find paid events. Therefore, to access those events and services, you must purchase a membership for that event. You can find the fees for the different memberships in the calendar section. The fees for your event membership will be a one-time payment for that event which will be charged along with any applicable taxes in your country. Any changes to your membership such as upgrades or downgrades may result in a change in the billing date. By accepting this agreement, you agree to pay for the purchase of the membership that allows you to access the services and features of Track It Up that vary depending on the type of membership you choose. Track It Up reserves the right to change or establish new values ​​in membership fees or apply any tax where applicable in the country where you are located when required by law. Any changes in this regard will be communicated with a reasonable amount of notice.

Cancellation

Membership Cancellation

If you have purchased a membership on Track It Up, you have the right to cancel it at any time by accessing the profile section and clicking on delete account or by contacting our support team at support@trackitup.co, membership cancellation will take effect upon completion of the current billing cycle. You can delete your account and all your personal and progress information if you wish. To do this, you must write an email to the address support@trackitup.co making the express request to Track It Up to delete all the information it has stored in all its repositories. By doing this, you acknowledge that you will not be able to recover your progress and other information uploaded by you to Track It Up.

Free Trials

You can start with a free trial at Track It Up, which will begin when you accept it and last for a period determined by Track It Up. If you start with a free trial, you can sign up for paid events by making payments. If you do not wish to continue with the membership after your free trial ends, cancel it during this trial period.

Conduct

At Track It Up, we care about creating a healthy environment where competitiveness and respect are the foundation. Therefore, by accepting this agreement, you agree to comply with the following rules applicable to the Track It Up community, avoiding:

1. Posting inappropriate or offensive content, obscene, illegal, racist, defamatory, abusive, generating hatred against any population group, threatening, or generating violence, or engaging in phishing.
2. Posting malicious content that endangers the operation of software, hardware, networks, web services, or others.
3. Posting content protected by copyright or copyright laws, patents, trademarks.
4. Posting content that violates the privacy of other users or other people.
5. Allowing a person other than yourself to access the platform’s services in your name.
6. Copying the functionalities of the platform for use by others.
7. Accessing the platform to analyze its functionalities, the availability of its services, and its performance.
8. Using maneuvers to avoid making the corresponding payment for the membership indicated for the platform’s services.
9. Using our services for advertising purposes not approved by Track It Up;
10. Engaging in any act that violates the laws in force in your country and that could constitute a criminal offense and incur civil liability.
11. Any type of behavior that acts against the integrity of any minor.
12. Any type of action that could be considered cheating to improve your times and performance.
13. Altering in any way your wearable (smartwatch, cycle computer, etc.) to improve your times and performance.
14. Engaging in any type of engineering process or reverse engineering to reproduce any functionality of Track It Up or that allows extracting the source code of the platform.
15. Attempting to interrupt, impair, damage, or violate the integrity or security of the Services or third-party computers, services, Accounts, or networks (including, among others, “hacking,” denial-of-service attacks, etc.), including any activity that typically precedes attempts to violate security such as scanning, probing, or other vulnerability assessment tests or activities, as well as participating in, or allowing, any network or hosting activity that blacklists or otherwise blocks Track It Up’s Internet protocol space;
16. The distribution or disclosure to any extent of the Services in any medium including, among others, through automated or non-automated scraping (content extraction);
17. Collecting or gathering information from an identified or identifiable person, including user names or other information from the Services, from the Services;
18. Accessing any content of the Services through any technology or medium other than those provided or authorized in the Services;
19. Sending to the Services or Track It Up any information that may be protected from disclosure by the law in force;
20. Ignoring measures that we may use to prevent or restrict access to the Services, including, among others, functions that prevent or restrict the use or copying of any content or the application of limitations on the use of the Services or the content in them;
21. Any copyright, trademark, or property rights notices contained in the Services; or
22. Executing any form of network control or running a network analyzer or packet analyzer or other technology to intercept, decode, extract, or display any packet used to communicate between the servers of the Service or any data not intended for you.

If you wish to create a hyperlink leading to the app, website, or another platform of Track It Up, you will do so accepting that under no circumstances can it be for commercial use and also that it cannot contain misleading, defamatory, or derogatory information about Track It Up, they cannot be hosted on sites where pornography, illegal material, material that generates any kind of hatred towards minority, racial, or gender groups or that is questionable in any way.

Track It Up also authorizes you to implement RSS feeds for your exclusive personal use. Track It Up reserves the right to revoke these permissions at any time with or without reason.

Track It Up is a platform that bases its functions on data collected through devices such as watches, cycle computers, bands, among others, that are manufactured by third parties; therefore, the data of your activities such as times, distance, pace, or altitude gained will depend on the status of your devices and the information that Track It Up consumes from the platforms of these third parties. In no case does Track It Up manipulate the collected data, therefore, it is not responsible for errors generated by information from the manufacturer’s platform of your device or its malfunction.

Interaction with Members

The Track It Up platform is a place where you can share with other users, interact with them, and above all compete, all in a

 virtual environment. By accepting this agreement, you commit to behaving respectfully towards them and agree that you understand that Track It Up has no influence on its users’ interactions and therefore cannot ensure the quality, truthfulness, legality, or security of what other users post.

Track It Up is not responsible for validating and confirming the identity of its users. Track It Up constantly develops and improves algorithms that allow detecting potentially cheating activities; however, it will not be responsible for undetected cheating behaviors or for carrying out confirmations of activities or potentially cheating skills not detected by anti-cheating algorithms.

Third Parties

Track It Up is solely responsible for official competitions registered as such on the platform. If you decide to enter an UNOFFICIAL EVENT OF Track It Up that may be organized by a club within the platform or by a third party that contracts the service to Track It Up, you accept to know that the awards, registration fees, routes, participants, or any other aspect will not be the responsibility of Track It Up, and you understand that in this case, you are contracting with the third party and not with Track It Up. Therefore, you accept to understand that Track It Up IS NOT RESPONSIBLE IN ANY WAY FOR LOSSES OR DAMAGES CAUSED TO YOU BY COMPETING IN THIRD-PARTY EVENTS.

Property Rights

By accepting this agreement, you acknowledge that the Track It Up platform, which includes the APP, the website, or any present or future software that allows the Track It Up service, belongs to Track It Up and contains proprietary and confidential information protected by copyright laws in force. Therefore, you understand and agree that you may not modify, create derivative works based on the services of Track It Up, lend, rent, assign, or sell except for the material that the platform allows sharing wholly or partially.

By acquiring a membership from Track It Up, you acquire a personal, non-transferable, revocable license (if this agreement is breached), and non-exclusive use of the services of Track It Up in any of the components of its platform and limited by the type of membership acquired, provided that its use does not include copying it or allowing it to be copied, modifying it, reverse engineering it, creating a derivative work from it, or attempting to discover the source code in any way, lending it, renting it, assigning it, or selling it. By acquiring the membership, you agree to use it only under the guidelines of use of Track It Up.

The term Track It Up, the Track It Up logo, and other logos, products, and service names of Track It Up are exclusive trademarks protected by current copyright laws in favor of Track It Up therefore, any use of these trademarks for commercial or non-commercial purposes must be explicitly authorized by Track It Up.

Track It Up reserves all rights not explicitly granted in this agreement.

Membership Revocation

By accepting this agreement, you acknowledge that Track It Up may, under circumstances it deems serious at its discretion and without the need for prior notification, immediately revoke your membership. Causes for this include, but are not limited to, breach of the terms and conditions you accept in this agreement, explicit request from a law enforcement agency, termination of your membership period and non-renewal of it, a request from you to delete it in the profile settings, among others.

By revoking your membership, Track It Up will delete all information it contains and block access to and use of its services.
